Commencing April 29, 2016, laws will come into effect which make it a requirement for a Vendor (or a Lessor) to supply a Certificate of Compliance when conveying or leasing a property with a swimming pool. There is an exemption if the pool is on strata title or community title land and the scheme has more than two lots.

There’s some good sense behind the laws – primarily the prevention of drownings arising from swimming pools which are inadequately fenced. However, the commencement of the law has been delayed twice.

If you are buying or selling a house with a swimming pool make sure your lawyer knows the existence of the pool.
