What is Probate and when do I need it?

Probate is the process of “proving” the Will of a deceased person and is a declaration by the Supreme Court authorising the named Executor to administer the deceased’s estate.

Many “asset holders” such as banks, share registries and in particular the NSW Registry of Land and Property Information will not transfer or transmit assets out of the name of the deceased person and into the name of beneficiaries without providing a copy of the Grant of Probate.

There are also other protections offered by statute to Executors of estates upon a Grant of Probate.
