What are the rules of service of documents under the Strata Act?

Sections 262, 263 and 264 of the Strata Schemes Management Act sets out the rules of service on and by Owners Corporation (or other persons) respectively.

As always you should closely adhere to the rules of service to ensure any application or notice you file isn’t ‘thrown out’ because it wasn’t served properly.

Section 76 of the Interpretation Act 1987 (NSW) provides that if a document is to be served by post (which will often be the case in Strata until all lot owners agreed to service by email), service is taken to be effected (within Australia) on “the seventh working day after the letter was posted”.

Remember, these sections are only for the service of documents or notices required under the Strata Schemes Management Act 2015. These sections do not apply to other documents outside that Act (for example a Statement of Claim filed in the District or Supreme Court).
